Based on observation and interview, the licensee did not comply with the section cited above as LPA observed that Licensee did not have a working pool alarm with proof of compliance with ASTM International Standard F2208 which poses a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee agrees to obtain a working pool alarm that meets the ASTM International Standard F2208 and agrees to maintain the pool alarm to meet requirements. Licensee agrees to send proof of the Plan of Correction (POC) to Community Care Licensing (CCL) by the end of the business day on the POC due date of 04/24/2025.
Based on observation and interview, the licensee did not comply with the section cited above as LPA observed that Licensee did not have a life ring with a minimum exterior diameter of 17 inches and labeled as approved by the US Coast Guard which poses a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee agrees to obtain a life ring with a minimum exterior diameter of 17 inches and labeled as approved by the US Coast Guard to meet requirements. Licensee agrees to send proof of the Plan of Correction (POC) to Community Care Licensing (CCL) by the end of the business day on the POC due date of 04/24/2025.
Based on observation and interview, the licensee did not comply with the section cited above as LPA observed that Licensee did not have a rescue pole with a body hook and a minimum fixed length of 12 feet which poses a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee agrees to obtain a rescue pole with a body hook and a minimum fixed length of 12 feet to meet regulation requirements. Licensee agrees to send proof of the Plan of Correction (POC) to Community Care Licensing (CCL) by the end of the business day on the POC due date of 04/24/2025.
Based on interview and record review, the licensee did not comply with the section cited above as LPA observed that the Licensee did not have a completed daily inspection log of the drowning prevention safety features and safety equipment that is to be conducted before opening the facility which poses a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee agrees to update and conduct a daily inspection before opening the facility of the drowning prevention safety features and safety equipment. Licensee agrees to maintain a log documenting these inspections. Licensee agrees to send proof of the Plan of Correction (POC) to Community Care Licensing (CCL) by the end of the business day on the POC due date of 04/24/2025.
Based on observation and interview, the licensee did not comply with the section cited above as LPA observed an inground pool in the backyard area of the facility that did not have a five foot tall fence with a self closing and self latching gate surrounding it per Title 22 regulations which poses an immediate health, safety or personal rights risk to persons in care.
Resolution: Licensee agrees to submit a plan of action on how Licensee plans to keep children safe while pool fencing is installed per Title 22 regulations. Licensee agrees to include in plan an estimated date of installation for the pool fence. Licensee agrees to submit the plan to Community Care Licensing (CCL) by the end of the business day on the Plan of Correction (POC) due date of 12/09/2023.
