Based on observation, the licensee did not comply with the section cited above, the Licensee has an above the ground pool in the backyard that is 4 ft in depth and does not have a 5 ft fence around it, which poses an immediate health, safety to persons in care.
Resolution: LIcensee agrees to have a 5 foot fence around the pool or drain the pool and replace it with a 5 ft pool by POC date. Licensee will send pictures of the pool fence or a picture of the pool completely drained and put away. once new pool or fence is installed, LPA will conduct an inspection visit once complete. Civil Penalty was issued.
