During the inspection, it was determined that a child was left unattended and not supervised, in that the provider stated when answering the door that she was not open for care due to a medical appointment later in the day. The provider's hours were posted and there was not a sign posted stating the closure. We discussed the complaint allegations on the porch and then entered the home and a child four years old was found to be inside and was not within sight or hearing while the discussion was taking place on the front porch. Submit the programs corrective action plan to verify compliance with the requirements of this rule.

During the inspection, it was determined that outdoor play equipment was unsafe as noted in the number 3 below: 1. There was rust exposed.2. There was protruding bolts. 3. There were cracks.4. There were holes.5. There was splintering wood.6. There were sharp edges or points.7. There were lead hazards.8. There were toxic substances.9. There were tripping hazards.10. The sandbox was not covered when the program was closed or during non-daylight hours. 11. Outdoor equipment, [ ], was not developmentally appropriate.12. Outdoor equipment, [ ], was placed in the main traffic pattern.13. Outdoor play equipment, [ ], was positioned too closely together, posing a risk of injury if a child were to fall from one piece of equipment into another.14. Outdoor equipment, [ ], was not securely anchored but did not present a risk of imminent danger of the structure collapsing when children are using the equipment15. Outdoor equipment, [ ], was 30 inches or more from the ground and did not have a protective barrier that would prevent a child from falling off this piece of equipment.16. The manufacturer's guidelines for assembly and installation were not followed for the [ ].17. Other [ ]. During the inspection, it was determined that an outdoor play area was used which was not protected from traffic and other hazards by a fence in good repair, or other barrier. Although the fence or natural barrier was not meeting the rule requirements, it was determined to not present an immediate risk for a child to be able to leave the playground. The fence or gate was not in good repair and/or being used inappropriately as noted in number 12 below: 1. The fencing had missing slat boards.2. The fencing was broken.3. The fencing was loose.4. The fencing was rotting.5. The gate was broken and did not close.6. The gate was locked.7. The latch on the gate was broken.8. The latch was easily opened by children on the playground.9. The latch was not engaged to prevent children from opening the gate.10. The gate had no latch. 11. There were bolts with more than two threads exposed along a fence line or gate on a playground.12. Other: The fence that is the neighbor's, is falling apart. There are boards that are broken off, nails and splintering. There is risk of children getting splinters, and/or possible cuts. Submit the programs corrective action plan to the Department to verify compliance with the requirements of this rule.

During the inspection, a potentially hazardous item or toxic substance was used or stored in a space used for child care during the program's hours of operation, but no children were present, as noted in number 5 below:1. A lawn mower. 2. A weed trimmer.3. Hedge trimmers. 4. A snow blower. 5. Other potentially hazardous substance, equipment or machinery: On the front porch there were hand held small gardening tools within access of children. There was also a pottery type crock that had a broken tip that was rough and could cut a child if they were to pick it up. Submit the programs corrective action plan, which includes a statement that the potentially hazardous substance or item is no longer accessible to children and/or children will not be outside when machinery is in use to the Department to verify compliance with the requirements of this rule.

In review of the children's records, it was determined that information had not been secured from the parent/guardian on the JFS 01234 Child Enrollment and Health Information For Child Care, as required, for the items in number(s) 4, 5, 6, 7, and 13 below: 1. During the inspection, it was determined that the playground did not have adequate fall surface under and around equipment as noted in the following number 1 below:1. No fall surface2. Adequate fall surface to soften the impact of a fall3. Other [ ] Any equipment designed for climbing, swinging, bouncing, or sliding needs a fall zone of protective material resilient under and around the equipment in order to protect children in the event of a fall. Submit the programs corrective action plan, which includes written verification of the discontinued use of this equipment until corrections are made along with a description of the resilient material added, to the Department to verify compliance with the requirements of this rule.
