(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training.

Based on interviews and record review, the licensee did not comply with the section cited above as the facility did not report to the Department the outbreak of Hand, Foot, and Mouth Disease, which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on interviews with parents and children in care who disclosed that teachers at the facility yelled at children in care.

Based on statement from original complainant and interviews with children and parents who disclosed staff pulled childs forearm and scolded a child, and hit a child, facility did not ensure childrens personal rights which poses an immediate health and safety risk to persons in care.

Staff #1 had completed 6 semester units but did not enroll in additional semester units after employment in September 2021. Staff #2 did not have any of the required 12 semester units to qualify as a teacher. Ratio was not met since both are not qualified as teachers. This poses an immediate health and safety risk to the children in care.
