Type A citation from complaint investigation - immediate risk

During inspection LPA and Director found a child C1 alone in class bathroom while room children and staff had left for outdoor activity. C1 was left alone without visual supervision for at least 24 minutes. This poses an immediate health, safety or personal rights risk to persons in care. $500 civil penalty assessed.

Title 22, Division 12, Chapter 1, Article 06 Section 101223 (a)(3) - (a)The licensee shall ensure that each child is accorded the following personal rights...interference with functions of daily living including eating, sleeping or toileting...physical functioning. This requirement was not met: based on interview and observations, it was determined that staff did not assist child with toileting.

One (1) child was unknowingly left inside the bathroom alone without adult supervision. This poses an immediate risk to the health, safety, and/or personal rights of the children in care.

This requirement is not met as evidence by: Based on interviews and record review the facility did not comply with the section cited above by not ensuring the facility is reporting all unusual incidents to Licensing within the required time frame.
