Based on observation and interview, the licensee did not comply with the section cited above where it was disclosed that licensee has been available since yesterday. Licensee stated, they believed 80% availability to be an annual expectation and not daily. Which poses a potential health, safety or personal rights risk to persons in care.

Resolution: By COB 2/23, licensee will email a written statement of agreeing and understanding to Regulation 102417(a). Licensee will also submit a written plan to LPA, stating how this regulation will be followed and provide a schedule of staff shifts when children are present.

Based on interview, record review, the licensee did not comply with the section cited above in 2 of 3 staff files reviewed. Staff 1 and staff 3 did not have current mandated reporter certificates available for review during inspection. Which poses a potential health, safety or personal rights risk to persons in care.

Resolution: By COB 2/23/24, Licensee will email LPA Chancellor proof of Mandated Reporter certificates for staff 1 and staff 3.

Based on interview and record review, the licensee did not comply with the section cited above in one out of three staff files reviewed.Unavailable for review during inspection, were proof of immunizations for staff 1. Which poses a potential health, safety or personal rights risk to persons in care.

Resolution: By COB 2/23/24, Licensee will email LPA Chancellor proof of immunizations for staff 1.

Based on observation, interview, record review, the licensee did not comply with the section cited above where 8 children ages 3- 5 years old were present with no school agers. Only two assistants were present without Licensee available for entire day. Which poses a potential health, safety or personal rights risk to persons in care.

Resolution: By COB 2/23, licensee will email a written statement of agreeing and understanding to Regulation 102416.5 Staffing Ratio and Capacity. Licensee will also submit a written plan to LPA, stating how this regulation will be followed and provide a schedule of staff shifts maintaining proper capacity and ratios.
