Based on observation and interview, the licensee did not comply with the section cited above in that the Licensee Lencee Harris was not present at the facility the entire day. Even though 1 of the 2 licensees has been present the entire day, the Licensee Lencee's temporary absence has exceeded more than 20% of the hours that the facility operates, which poses/posed a potential health, safety or personal rights risk to persons in care.
Resolution: Facility will submit a written statement on whether they plan to keep both names on the license or if they plan to remove one names from the license and instead utilize them as an "assistant". This will be submitted to the Department by the POC due date.
Based on observation and interview, the licensee did not comply with the section cited above in that from 1:15pm to 2:00pm the facility did not have an assistant present. The facility had 8 total children present with 3 of them being infants. The regulations state that there can only be 2 infants present when there are 8 total children present. This poses an immediate health, safety or personal rights risk to persons in care.
Resolution: Facility will submit a signed and dated written statement of understanding of CCR section 102416.5 Staffing Ratio and Capacity to the Department by 5/17/2025. Additionally, the facility offered to have assistants on standby for meeting ratio requirements during an emergency. Facility will submit the LIC9052 and Mandated Reporter Training for these assistants to the Department by 6/15/2025.
Based on observation, the licensee did not comply with the section cited above in that their were 2 cleaners that noted to call poison control if ingested. These 2 poisons were not accessible to children in care and were in a cabinet that did not have any handles, that was also barricaded by a heavy stepping stool. However, this does not count as being "locked" per the above regulation. This poses/posed a potential health, safety or personal rights risk to persons in care.
Resolution: Facility moved the poisonous cleaners to a locked off limits room immediately upon notification of their presence. This brought the facility back into compliance during this visit. Additionally, facility will submit a signed and dated written acknowledgment of understanding of CCR 102417(g)(4)(A) to the Department by the POC due date.
Based on record review, the licensee did not comply with the section cited above in that the files for Staff 2 (S2), and S3 did not have LIC9052 available to review. Also, the file for S3 did not have Mandated Reporter Training available to review, which poses/posed a potential health, safety or personal rights risk to persons in care.
Resolution: Facility will submit copies of: LIC9052 for S2 and S3, and Mandated Reporter training certificate for S3. to teh Department by the POC due date.
Based on record review, the licensee did not comply with the section cited above in that Child 2 (C2) and C3 did not have a completed LIC9227 which poses/posed a potential health, safety or personal rights risk to persons in care.
Resolution: Facility will submit copies of a completed LIC9227 for C2 and C3 to the Department by the POC due date.
Based on record review assistant did not have her immunization record which poses/posed a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee stated she will provide the assistant's immunization record and send a copy to CCL by 3/11/24.
Based on record review, the licensee did not comply with the section cited above in persons which poses an immediate health, safety or personal rights risk to persons in care. LPA observed an adult (assistant) not fingerprint cleared or assoicated to the home.
Resolution: Licensee immediately removed adult from the facility. Licensee stated she will have adult cleared and associated to the facility before adult can return to work. Licensee will send a written statement of acknowledgement, understanding and compliance to the regualtion to CCL by 6/9/23.
