Based on observation, interview, and record review, the licensee did not comply with the section cited above due to none of the 14 children present during the visit meeting the criteria in HSC 1597.465 of being enrolled and attending Transitional Kindergarten or above. This poses an immediate health, safety, or personal rights violation to persons in care.

Resolution: Licensee stated that two of the children were present only due to emergency situations and acknowledges the need to remain within ratio. Licensee will provide LPA with a schedule of the rest of the week's attendance by the POC due date, and LPA wil conduct a return visit to ensure compliance.

Upon arrival, LPA observed a total census of 14 preschool children supervised by licensee and their adult assistant. Licensee stated no others were present in the home today. Licensee guided LPA on a tour of the facility, and a health and safety inspection was conducted in all areas accessible to children. Off-limits areas include all upstairs, garage, and laundry room. Licensee acknowledged that children must never enter these areas. LPA observed the required postings, a working phone, 2A10BC fire extinguisher, and functioning smoke and carbon monoxide detectors. Toxic and hazardous items are inaccessible to children. Per Licensee, there are no weapons in the home and LPA did not observe bodies of water on the property. Stairs in the home are properly barricaded. There is a disconnected gas fireplace that is not used. Outdoor play space is fenced. Criminal record clearances were verified and licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. LPA reviewed 14 children’s files along with personnel files and observed both to be complete. Through interview and record review, LPA determined that all 14 children present were preschool aged. A current roster is being maintained and fire and disaster drills are documented. Current AB1207 mandated reporter training for licensee was verified and expires 8/2026. Pediatric CPR and First Aid certification was verified and expires 11/2026. LPA reminded licensee that Pediatric CPR and First Aid must be renewed through an EMSA approved training program. LPA also informed licensee the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Title 22 deficiencies are cited on the subsequent pages of this report. Licensee acknowledges, that FOR TYPE A DEFICIENCIES ONLY upon receipt, licensee shall post LIC 809D with Type A deficiencies for 30 days and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. LIC 9224 must be signed by parents/guardians and kept with the children's forms as a receipt whenever any Type A documents are provided by the licensee. LIC 9224 and Appeal Rights were provided. Based on observation, the licensee did not comply with the section cited above when there were 17 preschool children in care today. The capacity specified on the license is 14 children; therefore, licensee is over licensed capacity which poses an immediate health, safety or personal rights risk to persons in care.

Resolution: LPA discussed being over capacity with assistant, Anna and she started calling parents to pick up children. Five children went home during the inspection bringing the capacity to 12 preschool children in care. LPA explained to Ana that if she is to exceed 12 children to the licensed capacity of 14, then 2 children in care need to be school age. Deficiency was corrected when five children were picked up bringing the capacity to 12 preschool children.
