Based on interview and record review, the licensee did not comply with the section cited above in 5 out of 5 personnel files, which poses an immediate health, safety or personal rights risk to persons in care.
.5 9(b)-Staff-Infant Ratio- There shall be a ratio of one teacher for every four infants in attendance.(b) There shall be one teacher to every 12 sleeping infants provided the remaining staff necessary to meet the ratios specified in (b) above are immediately available at the center. This was evidenced by - LPA observed 6 infants with Staff #1 in the napping room. At lease three of the six infants were awake.One staff may be with 12 infants if asleep however once they are awake there must be staff available to supervise. There was no staff available as staff were at lunch. This is a immediate risk to the health & safety of children in care.
(C) Infant Care Activities -An infant shall not be swaddled while in care. This was evidenced by - LPA observed Child #1 swaddled while napping in a crib in the napping room. This is a potential risk to the health & safety of children in care.

In addition, LPA observed the licensee and Staff #1 with 12 infants. There was no staff available. This is a immediate risk to the health & safety of children in care.

This was evidenced by - LPA observed 2 infants unsupervised in the napping room. One was asleep on a cot and the other infant was awake in a crib. This is a immediate risk to the health & safety of children in care.

LPA observed one infant Child #1 on a cot with their head covered with a blanket. In addition, another child Child #2 with a blanket on them in the crib. This is an immediate risk to the health and safety of children in care.
