Based on interview and record review, the licensee did not comply with the section cited above. Licensee only had a Safe Sleep log up to 12 months for infants in care which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: License will submit a statement stating she has read Safe Sleep regulations to CCLD by POC date.

Based on observation, the licensee did not comply with the section cited above. Infants were forced to stay in a designated sleeping area which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee removed the infants during visit. License will submit a statement stating she has read Safe Sleep regulations to CCLD by POC date.

Based on interview, the licensee did not comply with the section cited above. Licensee stated she did not have a file for assistant Angelica Ramirez Benito which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee was informed all records must be kept for three years after staff departure. Licensee stated she understood regulation.

Based on record review, the licensee did not comply with the section cited above. Child 3 and 5 immunization records need to be updated which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee will submit updated immunization records for child 3 and 5 to CCLD by POC date.

Based on record review, the licensee did not comply with the section cited above. Child 3 and 5 are missing LIC627 which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee will submit LIC627 for child 3 and 5 to CCLD by POC date.

Based on observation, the licensee did not comply with the section cited above. LPA observed shampoos, conditioners and soaps in the bathroom shower and air freshener under the bathroom sink accessible to children which poses an immediate health, safety or personal rights risk to persons in care.

Resolution: Licensee removed items during visit. Deficiency cleared today.

Based on interview, the licensee did not comply with the section cited above. Licensee stated Angelica Ramirez Benito was her assistant for one month starting in January 2024 through the beginning of February 2024. Angelica Ramirez Benito did not have fingerprint clearance which poses an immediate health, safety or personal rights risk to persons in care.

Resolution: Licensee understands that Angelica Ramirez Benito may not return to work in the home until fingerprint clearance is obtained.

Based on observation and record review, the licensee did not comply with the section cited above. Licensee was alone caring for five infants, one preschool and one school age child. Licensee was out of ratio and over capacity which poses an immediate health, safety or personal rights risk to persons in care.

Resolution: Licensee will submit a plan on how she will remain within ratio to CCLD by POC date.

Based on observation and record review, the licensee did not comply with the section cited above. Licensee was alone caring for five infants, one preschool and one school age child. Licensee was out of ratio and over capacity which poses an immediate health, safety or personal rights risk to persons in care.

Resolution: Licensee will submit a plan on how she will not go over capacity to CCLD by POC date.

Based on observation, interview and record review, the licensee did not comply with the section cited above in, door to infant sleep room was closed with child C1, C2 and C3 which poses an immediate health, safety or personal rights risk to persons in care.

Resolution: Deficiency cleared immediately, door was opened during site visit, additionally licensee will submit a written of her understanding of safe regulations by close of business 07/07/2023.

Based on observation, interview and record review, the licensee did not comply with the section cited above in, 4 infants in care, one 5 year old child - overcapacity, which poses an immediate health, safety or personal rights risk to persons in care.

Resolution: Licensee called parent of child 3 to be picked up, licensee will also submit a written plan to the San Jose Regional Office explaining her plan to stay within ratio by close of business 07/07/23.

Based on observation, interview and record review, the licensee did not comply with the section cited above , Licensee states she has not started a child care roster since being licensed, which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee completed a child roster during site visit, deficiency cleared.

Based on observation, interview, the licensee did not comply with the section cited above in Child C2 was asleep with pacifier attached to child's clothing, which poses an immediate health, safety or personal rights risk to persons in care.

Resolution: Child 2 had attached pacifier removed from sleeping area. Deficiency corrected immediately.
