Based on observation and interview, the licensee did not comply with the section cited above in which poses an immediate health, safety or personal rights risk to persons in care. Upon arrival LPA Garcia observed the only licensee in care of 12 children without an asistant present. Licensee stated the assistant was present earlier but left early. LPA did not observe the assistant return.
Resolution: Licensee will operate as a small family child care home when she does not have an assistant present to help with the care and supervision of children.
