Based on observation, interview and record review, the licensee did not comply with the section cited above in that LPA observed that the in-ground swimming pool and in-ground jacuzzi did not have an enclosure to isolate the swimming pool from access to the daycare home home which poses an immediate health, safety or personal rights risk to persons in care.

Resolution: Licensee stated that he will secure both in-ground bodies of water and will provide proof to the Department, no later than 6/17/2025.

Based on observation and interview, the licensee did not comply with the section cited above in that the fire extinguisher was empty during the time of inspection which poses a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee stated that he will purchase or refill the fire extinguisher and provide proof to the Department, no later than 6/19/2025.

Based on observation and interview, the licensee did not comply with the section cited above in that there was not an alarm in the in-ground jacuzzi during the time of inspection which poses a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee stated he will purchase an alarm for the swimming pool and provide proof to the Department, no later than 6/23/2025.

Based on observation, interview and record review, the licensee did not comply with the section cited above in the Department was not notified of fencing being removed from in-ground bodies of water located in the backyard of the daycare home which poses a potential health, safety or personal rights risk to persons in care.

Resolution: LPA provided Licensee with a copy of Title 22 Regulation 102416.3 Alteration to Existing Building and Grounds for review and requested a signature acknowleging that the regulation has been review. Licensee stated that he will submit proof to the Department no later than 6/19/2025.
