Based on observation, the licensee did not comply with the section cited above. LPA observed an infant asleep in the nap room holding on to a stuffed animal which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee removed stuffed animal during visit. Deficiency cleared today.

Based on record review, the licensee did not comply with the section cited above. Licensee did not have a current CPR and First Aid certification on file which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee will submit a current CPR and First Aid certification to CCLD by POC date.

Based on record review, the licensee did not comply with the section cited above. Child 4 is missing LIC9227 which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee will submit LIC9227 for child 4 to CCLD by POC date.

Based on interview and record review, the licensee did not comply with the section cited above. Licensee did not have a current safe sleep log for infants in care which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee will submit a Safe Sleep log for infants in care beginning today 09/19/2024 through 09/19/2024 to CCLD by POC date.

Based on observation, the licensee did not comply with the section cited above. Licensee removed the stuffed animal waking the infant up which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee will submit a statement stating she understands the above regulation and may not interfere with children's sleep to CCLD by POC date.

Based on observation, interview and record review, the licensee did not comply with the section cited above in Positing PUB 394, Family Child Care Home Notification of Parents’ Rights Poster was missing during site visit which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: LPA provided a PUB 394 to licensee who posted in prominent publicly accessible area during site visit.

Based on observation, interview and record review, the licensee did not comply with the section cited above in missing PM 286 for child 1 (c1), c2, and c5, which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee will submit a copy of completed PM 286 for C1, C2 and C5 to the San Jose Regional Office by close of business 03/30/2023.

Based on observation, the licensee did not comply with the section cited above in licensee had bottle of aspirin, mouthwash, and personal hygiene products in unlocked closet next to infant sleep room, garage was unlocked and accessible to children in care with laundry detergent and cleaning supplies which poses an immediate health, safety or personal rights risk to persons in care.

Resolution: Deficiency cleared during site visit, Licensee locked garage door and moved accessible items from closet.

Based on observation, interview and record review, the licensee did not comply with the section cited above in Child 3 (c3) file is missing LIC 9227 Individual Infant Sleep Plan, which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee will submit a completed LIC 9227 for C3 to the San Jose Regional Office by 03/17/2023.

Based on observation, interview and record review, the licensee did not comply with the section cited above in missing infant safe sleep 15-minute log missing for Child 1 (c1), c2 and c3, which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee will submit a copy of 15 minute infant sleep log for C1, C2 and C3 to the San Jose Regional Office by close of business 03/15/2023.

Based on observation, interview and record review, the licensee did not comply with the section cited above in Child 3 (C3) missing from facility roster which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee updated roster with child 3 during site visit.

Based on observation, the licensee did not comply with the section cited above in door was closed in room with infant Child 1 (C1) sleeping which poses an immediate health, safety or personal rights risk to persons in care.

Resolution: Deficiency corrected during site visit, licensee opened door where C1 was sleeping.

Based on observation, interview and record review, the licensee did not comply with the section cited above in licensee was not able to provide proof of conducting fire and disaster drills which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee will submit a copy of proof of conducting fire drills and disaster drills to the San Jose Regional Office by close of business 03/30/2023.

Based on observation, the licensee did not comply with the section cited above in infant bassinet had hanging plush toys on top of bassinet with sleeping infant C1 inside, which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Deficiency cleared during site visit, licensee removed hanging plush toys.

Based on observation, interview and record review, the licensee did not comply with the section cited above in licensee and Assistant 2 (A2) and A3 did not provide proof of completion or renewal of Mandated Reporter Training which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee will submit a copy of completed Mandated Reporter Training certificates to the San Jose Regional Office by close of business 03/30/2023.
