Based on observation the licensee did not comply with the section cited above as there were 11 children (4 infants and 7 preschool age) without an assistant present, which poses an immediate health, safety or personal rights risk to persons in care.
Resolution: By POC date, licensee shall comply with the capacity requirements for a small family child care home if there is no assistant present. An assistant is required at all times to operate as a large family child care home. Licensee is to submit a statement of understanding of this regulation and submit to LPA via email by 1/23/23. LPA will return on another date to ensure compliance. ***Failure to correct will result in a $100 per day civil penalty until corrected. Repeat violations are $250 per violation and $100 per day until corrected.
