§1596.8662 (b) (1)   Availability of information regarding detecting and reporting child abuse and neglect; training for mandated reporter who is licensed day care provider, administrator, or employee of a licensed child day care facility; proof of completion (b) (1)   On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training.

Based on record review, the licensee did not comply with the section cited above in staff members not having lic 503 and proof of immunizaions or flu declinations which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on observation and record review, the licensee did not comply with the section cited above in Disaster drills were not documented which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on observation,interview and record review, the licensee did not comply with the section cited above in staff member did not have crimminal record clearance and another staff member was not associated to facility which poses an immediate health, safety or personal rights risk to persons in care.

Based on results received from the certified water samplers, the facility exceeded 5.4 ppb of lead in their water source. Once received, the facility took immediate and proper actions to remediate the fixtures. This poses a potential health, safety, or personal rights risk to persons in care.

(d) Disaster drills shall be conducted at least every six months. (2) The drills shall be documented. This documentation shall be kept in the child care center for at least one year.

Personal Rights (a)The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirment was not met, as evidenced by: Based on the interview and record review, the Center did not comply with the above regulation. A staff member pulled C1’s hair to demonstrate how it felt when C1 pulled others’ hair. This intention violated the child’s personal rights, which poses a potential health and safety risk to the children in care.
