Based on observation, the licensee did not comply with the section cited above: Her son, Angel Garcia, does not have eligible clearance to be in the home and/or live in the home, in which poses an immediate health, safety or personal rights risk to persons in care.

Resolution: Licensee will submit proof that her son does not live there by Plan of Correction due date, July 22, 2025.

Based on [(observation) (interview) (record review)], the licensee did not comply with the section cited above in Off limit room 4 door does not close, make up and personal hygiene products and a medicine bottle are accessible to children in care, which poses an immediate health, safety or personal rights risk to persons in care.

Resolution: Licensee will submit a photo of installed gate or fix door to room 4 door so it closes properly to San Jose Regional Office by close of business 05/05/2023.

Based on [(observation) (interview) (record review)], the licensee did not comply with the section cited above in Child 3 was inside play pen with broken mattress which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee removed infant child 3 and removed broken infant playpen during site visit.

Based on [(observation) (interview) (record review)], the licensee did not comply with the section cited above in off limit hallway bathroom is being used for children in care which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee will submit a written statement of her understanding of the regulation to the San Jose Regional Office by close of business 05/12/2023.
