Based on observation, the licensee did not comply with the section cited above. LPAs did not observe a child safety gate for the stairs and the licensee stated she has a child in care who is 4 years old, which poses/posed a potential health, safety or personal rights risk to children in care.

Resolution: LPAs informed the licensee that a future visit will be required to clear the deficiency.

Based on observation and interview, the licensee did not comply with the section cited above. The licensee stated the upper level of the home is being used for children overnight, which poses an immediate health, safety or personal rights risk to children in care.

Resolution: The licensee stated she will set up the upper level for the children and will contact the department once it is set up. A new facility sketch and a written statement indicating the use of the upper level must be completed and submitted to the department to clear the deficiency. LPAs informed the licensee that a future visit will be required to clear the deficiency.
