HEALTH RELATED SERVICES: 101226(a):...licensee shall immediately notify the child's authorized representative if the child... sustains an injury more serious ... licensee shall obtain specific instructions from authorized representative regarding action ...taken. Based on the information obtained during interviews, observations, and documentation reviewed it is determined that facility staff did not immediately report the injury of child 1 to responsible party which posed a potential health, safety, or personal rights risk to children in care.
Based on record review, the licensee did not comply with the section cited above as one staff (Zyntia Acosta) did not have a copy of immunization to indicate that she has been vaccinated against Pertussis and Measles. This poses a potential health, safety or personal rights risk to persons in care.
Based on record review, the licensee did not comply with the section cited above. Three staff did not have a current Mandated Reporter or has taken the wrong component. This poses a potential health, safety or personal rights risk to persons in care.

On 4/9/21 Child #1 was left in the bathroom alone and covered in excrement with no teacher present. On the same day, Staff #1 was photographed with eyes closed while that staff was alone supervisng the children. This poses an immediate risk to children in care.

Based on staff records LPA found that Staff Anna Gorman had a criminal record clearance which was not associated to the facility. This poses a potential health and safety risk to children in care.
Based on record review and statement by Mrs. Garcia, staff Hannah Aceves & Claudia Laevanos failed to obtain a health screening as previously requested on 2/15/23.
Based on staff records LPA found that Staff #1 had criminal record clearance but was never associated to the facility in the months she worked and Staff #2 was hired 7/23/19 and had criminal record clearances but was not associated to the facility until 4/27/21. This poses a potential health and safety risk to children in care.
(2) Each person specified in (g) above shall have a health-screening report signed by the person performing the screening. This report shall indicate the following:
(1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year.
(g) The licensee shall document each child's immunizations and shall maintain such documentation in the center for as long as the child is enrolled.
(1) The center shall give each authorized representative a copy of the Personal Rights form (LIC 613A [9/96]).

Director admitted that she did not submit incident reports as required for incidents occurring on 4/9/21 when Chilld #1 was left alone in bathroom and Staff #1 was alseep while supervising children at nap time. This poses a potential health and safety risk to children in care.
