Staff admitted to placing a waffle against a child's face in one incident and smearing cream cheese on a child's face in another incident. She stated that these act were done in a playful manner and was not done to tease them. Child became upset when staff smeared cream cheese on his face and cried.
Based on the interview conducted by LPA, one staff admitted that she forgot to report to the parent of child when child had minor injury. This poses a potential risk to the health, safety or personal rights of children in care.
(a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.

(1) A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test.
(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training.

(b) The licensee may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children in attendance.

Based on the interviews with staff and review of records that included Children's sign in/out and Employee timesheet it was revealed that the facility was out of ratio on 9/20/21 when a teacher called in sick. Ms. Foster and an aide were supervising 20 preschool children.

Based on the interviews conducted with staff/parents and LPA's observation of the facility's physical plant, it was determined that the facility was not safe due to the latch to the fence was broken, fence had holes that a child can fit through, holes in the play area that poses a tripping hazard and the barricades that were not sturdy and not anchored properly. This poses a potential risk to the health, safety and personal rights of children in care.
