Based on observation and interview with the Director, the licensee did not comply with the section cited above as the facility had recently replaced the play structure at their preschool and pre-k playground. The construction started in May and it was completed at the end of June of 2023. Facility did not notify licensing prior to the alterations. This poses/posed a potential health, safety or personal rights risk to persons in care.

Criminal Record Clearance All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: Request a transfer of a criminal record clearance as specified in Section 101170(f). This requirement is not met as staff Andrehya Azzato has been working at the facility for over a year and her fingerprint is not associated to the facility. This poses a potential health and safety risk to children in care.

101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.

(B) Staff shall physically check on sleeping infant(s) every 15 minutes and document the following: (3) Infants up to 12 months of age who are sleeping in a position other than on their back. Based on record review, the licensee did not comply with the directive above, as one out of seven outlet (outlet used for drinking) tested with an Action Level Exceedance (ALE). This poses an immediate Health and Safety risk to children in care.

.3 Observation of the Child (b) Any unusual behavior, any injury or signs of illness requiring assessment and/or administration of first aid by staff shall be reported to the child's authorized representative and recorded in the child's record. Based on LPA interviews and facility documentation, the injury to child C1 was neither observed, monitored, nor reported by staff, which posed a potential health, safety or personal rights risk to children in care.

Staff failed to provide visual supervision on 11/15/2024 during transition, a 2 year old child was left in the classroom while the rest of the children transitioned to the outdoor play area. According to staff, child was without visual supervision for approximately 2 minutes. This posesd a potential health, safety or personal rights risk to persons in care.
