Based on observation, the licensee did not comply with the section cited above LPA observed broken toys, unsanitary stuffed animals, children chair/sofa, adult chair, broken cabinet, and crack flooring in hallway that leads to infant classroom that is a tripping hazard in which poses/posed a potential health, safety or personal rights risk to persons in care.

LPA conducted a complaint investigation on May 11, 2022 and staff interviews and became aware of a day care child (C-1) incident that occurred on February 2022 where staff (S-1) used foot to avoid child ( C-1) from getting up. LPA did not have evidence to proof that child was punished or abuse. This poses a potential risk to the children in care.
(a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. (1) The licensee shall take measures to keep the center free of flies, other insects, and rodents.

All children are under supervision, including visual supervision, of a teacher at all times. Facility meets teacher-child ratios. LPA reviewed a sample of children’s files and observed files were complete with contact information for authorized representative and or relatives or others who can assume responsibility for the child and medical assessment. LPA reviewed a sample of staff files and observed files were mostly complete with health screening, immunization records for influenza, pertussis and measles and current documentation of completed mandated reporter training; one staff was missing the mandated reporter training as well as her immunization records. LPA discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to resources such as forms, regulations Provider Information Notices (PINs), and Quarterly Updates. LPA discussed Reporting Requirements as outlined in the regulations (Section 101212). Ms. Puga was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. LPAs observed that a teachers aid was not on the staff roster of cleared adults, LPAs verified that staff was finger printed at the time of hire but failed to complete a LIC 508 so the finger prints were never associated to the facility. Reporting Requirements: The name of the child care center director, and any fully qualified teacher(s) designated to act in the child care center director's absence, shall be reported to the Department within 10 days of a change of child care center director or designee(s). The facility has not submitted a completed director packet to Community Care Licensing (CCL) for review. This poses a potential risk to the health, safety, and personal rights of children in care.
Based on record reviews and interview conducted, on 11/29/2023 a parent had to call 911 after smelling gas. PG & E was called by staff (S-1) and confirmed by PG & E there was a gas leak. On 10/19/2023 Director was informed of a child (C-1) getting flea bites. Flea problem was not taken care of until 11/25/2023. Staff (S-1) realized they had a flea problem & have taken the steps to correct it. Staff (S-1) bug bomb classroom which poses a potential health and safety risk to children in care.
