Based on observation, interview and record review, the licensee did not comply with the section cited above in assistant Esperanza does not have crimianl record clearance, first day assisting was on 08/23/24, which poses an immediate health, safety or personal rights risk to persons in care.

Resolution: Licensee will submit proof of criminal background clearance to the San Jose Regional offfice by close of business 08/27/24 and assistant cannot assist until criminal background clearance has been obtained.

Based on observation,interview, record review, the licensee did not comply with the section cited above in Child 2 was in a baby sleeper during nap time, which poses an immediate health, safety or personal rights risk to persons in care.

Resolution: Licensee will use a infant crib and submit a written statement of her understanding of CCR 102425(a) to the San Jose Regiona Office by close of business 08/27/24

Based on observation, interview and record review, the licensee did not comply with the section cited above in, Child 1, was inside crib with no fitted sheet, which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee removed child from crib during site visit and provided fitted sheets.

Based on observation, Iinterview and record review, the licensee did not comply with the section cited above in, Child 1 had a blanket and a toy during nap time, which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee will send a written summary of her understanding of Safe Sleep regulations to the San Jose Region by close of business o8/30/24.

Based on observation,interview, and record review, the licensee did not comply with the section cited above in, Child 1 (C1), C2 and C3, do not have 15 sleep logs, which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee will send copies of safe sleep logs for C1, C2 and C3 to the San Jose Regional Office by close of business 08/26/24.

Based on observation, interview and record review, the licensee did not comply with the section cited above in licensee Olga certificate expired on 02/10/24, which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee will submit copy of completed Mandated Reporter Certificate by close of business 09/09/24.
