Based on interview and record review in guardian the licensee did not comply with the section cited above in that she left an unfingerprinted adult, Anastasia Escalante, to care for children in her absence which poses an immediate health, safety or personal rights risk to persons in care. A civil penalty will be assessed.

Resolution: Licensee will have Anastasia Escalante get fingerprinted and send proof by sending a copy of the completed and signed live scan form to LPA on or before POC due date. LPA informed facility representative if deficiency is not corrected by due date a civil penalty may be assessed. LPA gave and explained the LIC 9224 to facility representative at time of inspection.

Based on observation and interview the licensee did not comply with the section cited above in that there is no proof that she documents firedrills that are conducted which poses a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee will document fire drill and send LPA Owens copy of documentation on or before POC due date of 8/11/2023.

Based on observation, interview and record review the licensee did not comply with the section cited above in that Anastasia Escalante does not have proof of completing mandated reporter training which poses a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee will send a complete mandated reporter training certificate for Anastasia Escalante to licensing on or before POC due date of 8/11/2023. Training can be completed at www.mandatedreporterca.com website. Licensee was informed if deficiency is not corrected by due date a civil penalty may be assessed.

Based on observation and record review the licensee did not comply with the section cited above in a child under 12 months old at the facility does not have a completed Sleeping Plan LIC 9227 in file which poses a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee will send LPA a copy of a completed LIC 9227 -Infant sleeping plan for child under 12 months old. (See confidential names)

OPERATION OF FAMILY CHILD CARE HOME: All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. This requirement is not met by there is an inflatable water slide with a pool at the bottom that has standing water in it. This is an immediate risk to children. Type A citation issued.

Resolution: Licensee stated today was the first day and only day the inflatable water slide with a pool at the bottom will be in the back yard. She will be having the water slide removed from backyard today. While LPA's were present licensee deflated the water slide and let the water out of the water slide. Deficiency cleared at time of inspection.

CRIMINAL RECORD CLEARANCE: All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing, or volunteering in a licensed facility: This requirement was not met by licensee had a helper, Rosa Pantoja, assisting with children and she does not have a criminal record clearance. This is an immediate risk to children. This is a TYPE A citation and a civil penalty accessed. Licensee stated today is the only day she has assisted. (1) Obtain a California clearance or a criminal record exemption as required by the Department

Resolution: Licensee stated she will have Ms. Rosa Pantoja go through the finger print process by completing the required paper work. She understands Ms. Pantoja cannot be at the facility assisting with children during day care hours until she receives a finger print clearance. Due to computer problems unable to issue a civil penalty for criminal record clearance.
