(a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c) below.
Personal Rights. (a)The licensee shall ensure that each child is accorded the following personal rights:(2)To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.This requirement was not as evidenced by interviews during a complaint investigation and an unusual incident report that was reported to LPA via email on 12/21/22. On 12/15/22, Child #1 was found with a vape pen in her mouth by Staff #1 and Staff #2, after it was left on the playground from Staff #3. Evidence was also conclusive that Staff #3 previously used the vape pen in the staff break room on site. This posed an immediate risk to health and safety of children in care.
