Based on observation, the licensee did not comply with the section cited above in the a vertical clearance at the pool entrance exceeds 2 inches and has a gap of 3.25 inches from the ground, which poses a potential health, safety or personal rights risk to persons in care.

Resolution: The licensee agrees to ensure in-ground swimming pool on the premises is equipped with, at minimum, the following drowning prevention enclosure, including, but not limited to, a fence, wall, or other barrier that isolates the swimming pool from access to the family daycare home and has all of the following characteristics: (iii) A maximum vertical clearance of two inches from the ground to the bottom of the enclosure and submit proof or repairs to the department by e-mail.

In addition the LPA observed 4 mesh panels sagging below 60 inch requirements, which poses a potential health, safety or personal rights risk to persons in care.

Resolution: The licensee agrees to ensure the swimming pool is be equipped with, at minimum,an enclosure, including, but not limited to, a fence, wall, or other barrier that isolates the swimming pool from access to the family daycare home and has all of the following characteristics: No gaps or voids that can allow the passage of a sphere with a diameter equal to or greater than four inches and submit proof of repairs by photo, video, work order by e-mail or mail.
