Based on observation, the licensee did not comply with the section cited above in that a section of the mesh fence had a three inch vertical clearance from the ground to the bottom of the fence, which poses/posed a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee agrees to make the correction and ensure the vertical clearance from the ground to the bottom of then fence is no more than two inches. Licensee agrees to submit photos to CCL by 5/14/25.
Based on observation, the licensee did not comply with the section cited above in that a pool alarm was not present or installed during the inspection, which poses/posed a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee agrees to obtain and install a pool alarm which meets ASTM F2208 standards. Licensee agrees to submit photos/videos of working alarm and proof that alarm meets ASTM F2208 standards to CCL by 5/14/25.
Based on observation, the licensee did not comply with the section cited above in that a life ring with a minimum exterior diameter of 17 inches and labeled as approved by the United States Coast Guard was not present, which poses/posed a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee agrees to obtain a life ring with a minimum exterior diameter of 17 inches and labeled as approved by the United States Coast Guard. Licensee agrees to submit photo to CCL by 5/14/25.
Based on observation, the licensee did not comply with the section cited above in that a rescue pole with a body hook and a minimum fixed length of 12 feet was not present, which poses/posed a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee agrees to obtain a rescue pole with a body hook and a minimum fixed length of 12 feet. Licensee agrees to submit photo to CCL by 5/14/25.
Based on observation, the licensee did not comply with the section cited above in that a daily pool inspection log was not present, which poses/posed a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee agrees to create a daily pool inspection log and submit a weeks worth of entries to CCL by 4/18/25.
Based on observation, interviews conducted, and records reviewed, the licensee did not comply with the section cited above as licensee did not ensure mandated reporter training was completed for all staff which poses a potential safety risk to children in care. A civil penalty of $250 is being assessed and provided.
Resolution: LPA discussed the mandated reporter training requirement and informed Licensee that certifications are to be AB 1207 compliant. LPA reminded Licensee to ensure all staff renew the course every two years. Licensee agreed to provide completed certificate for S2 to LPA by 07/19/2024.
Based on observation, interview and record review, the licensee did not comply with the section cited above in 2 out of 2 infant files reviewed. LPA was unable to review sleep check logs for Child #4 and Child #8 which poses a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee understands the importance of this regulation and will submit one week or 5 consecutive days of sleep check logs for Child #4 and Child #8 to LPA on or before the stated POC date of 07/20/2023
Based on observation, the licensee did not comply with the section cited above. LPAs observed an infant strapped into a carseat during inspection. Child was not being transported or sleeping. Child was observed in car seat for an estimated 15 minutes before removal by Licensee. This poses an immediate health, safety or personal rights risk to persons in care.
Resolution: Licensee was informed of the immediate health, safety or personal rights risk of utelizing a carseat for other purposes than transportation. Infant was removed from car seat. Licensee will immedietly cease this practice and will submit written understanding of this regulation to LPA on or before the stated POC date of 07/13/2023.
Based on observation, interview and record review, the licensee did not comply with the section cited above in 9 out of 9 children's files reviewed. LPA observed 7 files to be missing LIC9224 forms and 2 files with imcomplete LIC9224 forms for Type A dificiencies cited on 05/19/2023 which poses a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee understands the importance of this regulation and will have all enrolled children's authorized representatives sign and acknowledge LIC9224 forms for Type A deficiencies cited on 05/19/2023 and submit to LPA on or before the stated POC date of 07/13/2023.
Based on observation, interview, and record review, the licensee did not comply with the section cited above. LPAs observed a total of eight children in care, two of which were infants; the remaining six children were all under the age of 5 and/or not enrolled in kindergarden or age 6.. Licensee is operating out of ratio which poses an immediate health, safety or personal rights risk to persons in care.
Resolution: Licensee was informed of the immediate health, safety or personal rights risk of operating out of ratio. Two children were picked up from facility during visit reducing census to six children and proper ratios. Licensee will immedietly cease this practice and will submit written understanding of this regulation and terms of current license to LPA on or before the stated POC date of 07/13/2023.
Based on observation and record review, the licensee did not comply with the section cited above. Licensee's Mandated Reporter Certificate available to review expired and was not renewed within 2 years of initial completion. This poses a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee understand the importance of this regulation and will renew Mandated Reporter Certificate and provide to LPAs on or before the stated POC date of 07/27/2023.
Based on observation and record review, the licensee did not comply with the section cited above in one out of nine children's records reviewed. Child #8 did not have immunizations to review, which poses a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee understand the importance of this regulation and will obtain current immunization records for Child #8 and provide them to LPAs on or before the stated POC date of 07/27/2023.
Based on observation, interview, and record review, the licensee did not comply with the section cited above. Facility roster availble for review was not updated accordingly to reflect children currenlty in attendance of the facility which poses a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee understands the importance of this regulation and will update their facility roster to reflect current children enrolled and attending the facility. Licensee will submit updated facility roster to LPA on or before the stated POC date of 07/27/2023
Based on observation, interview and record review, the licensee did not comply with the section cited above in 2 out of 2 Infant files reviewed. LPAs observed Child #4 and Child # 8's filed missing LIC9227, infant individual sleep plan, which poses a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee understands the importance of this regulation and will obtain signed and completed LIC9227 forms for Child #4 and Child #8.Licensee will submit these documents to LPA on or before the stated POC date of 07/27/2023
