Based on observation and record review, the licensee did not comply with the section cited above in that A1 is residing in the home without a criminal record clearance, which poses an immediate health, safety or personal rights risk to persons in care. A1 was previously fingerprinted, however; due to the application being incomplete it was closed.
Resolution: Licensee agrees to have A1 get a new live scan and submit the completed live scan form to CCL by 10/20/25.
Based on observation, the licensee did not comply with the section cited above in that the two access gates key lockable devices do not measure 60 inches above the ground, which poses/posed a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee agrees to ensure the two access gates key lockable devices are placed no lower than 60 inches above the ground. Licensee agrees to submit a photo/video of the correction to CCL by 11/17/25.

Based on LPA's observation, the licensee did not comply with the section cited above in, LPA Hogue smelled an odor of smoke in the day care bathroom. Per Licensee, Adult Resident/Staff #2 smokes in the garage, but not during day care hours. Smoking on or around the premises of the facility poses an immediate health, safety or personal rights risk to persons in care.
Resolution: Immediately, Licensee agrees to cease operation of smoking in the garage/residence. During this inspection, LPA Hogue reviewed Title 22 Regulation 102424(a) and Assembly Bill 1819 with Licensee and provided a copy of the aforementioned regulation to Licensee. Licensee stated she understands that smoking on the premises of a family child care home is prohibited.
Based on observation, the licensee did not comply with the section cited above in, LPA Hogue observed children under 24 months, napping in play yards with a pacificer attached to his/her clothing, along with a loose blanket and stuffed animals in the play yards which poses an immediate health, safety or personal rights risk to persons in care.
Resolution: Immediately, during this inspection, Licensee removed the loose items and pacifier from the play yard. During this inspection, LPA Hogue reviewed PIN 20-24-CCP with Licensee and provided Licensee with a copy of the aforementioned PIN.

Based on observation record review, the licensee did not comply with the section cited above in, Licensee physically checks on sleeping infants every 10 minutes; however, does not document sleep checks which poses/posed a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee agrees to continue to physically check infants every 10 to 15 minutes and agrees to document sleep checks on sleep log. Licensee agrees to provide sleep log for enrolled children under 24 months on or by 10/13/2022.
Based on observation record review, the licensee did not comply with the section cited above in, Licensee did not have immunization records on file for Staff #3, Staff #4, and Staff #5 which poses/posed a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee agrees to provide proof of immunization against measles (MMR), pertussis (Tdap), and proof of flu vaccine or statement declining flu vaccine on or by 10/28/2022.
Based on record review, the licensee did not comply with the section cited above in, Licensee did not have LIC508-Criminal Record Statement on file for Staff #4, Staff #5, and Adult Resident #6 which poses/posed a potential health, safety or personal rights risk to persons in care.
Resolution: During this inspection, Licensee provided a copy LIC508-Criminal Record Statement for Staff #4 and Adult Resident #6. Licensee agrees to provide a copy of LIC508 for Staff #5 on or by 09/30/2022.
Based on observation record review, the licensee did not comply with the section cited above in, Licensee did not have immunization records on file for Staff #3, Staff #4, and Staff #5 which poses/posed a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee agrees to provide proof of immunization against meales (MMR), pertussis (Tdap), and proof of flu vaccine or statement declining flu vaccine on or by 10/28/2022.
Based on record review, the licensee did not comply with the section cited above in, Licensee did not have proof of immunization record on file for Child #2. Licensee also did not document Child #1 and Child #3 immunization record on CDPH286 which poses/posed a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee agrees to submit immunization record for Child #1, Child #2, and Child #3 on or by 10/28/2022.
Based on observation record review, the licensee did not comply with the section cited above in, Licensee did not have LIC9227-Individual Infant Sleeping Plan on file for Child #1 which poses/posed a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee agees to provide proof of completed LIC9227 for any enrolled children under 12 months of age on or by 10/13/2022.
Based on observation, the licensee did not comply with the section cited above in, LPA observed shampoo; conditioner; and body wash stored behind an accessible shower located in the day care bathroom. LPA observed day care children having direct access to use the bathroom freely without direct supervision from Licensee/Licensee's Assistant. Items such as shampoo, conditioner, body wash, and other household items poses an immediate health, safety or personal rights risk to persons in care.
Resolution: During this inspection, Licensee removed the items in the shower and placed them behind Bedroom #1 which is key-locked. Licensee understands that these items must be made inaccessible to children during day care hours.
