1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25On 02/03/26 at 10:00 AM, Licensing Program Analysts (LPAs) Gerald Poindexter and Jennifer Irving conducted an unannounced case management inspection to follow up on an unusual incident that was self-reported on 1/16/26. Upon arrival, LPAs met with and interviewed Director Leslie Heater. LPAs toured classrooms reviewed facility documents. LPA observed a total of 27 preschoolers in the following classrooms: · Room 1 had 12 children with 2 staff members · Room 2 had 15 children with 2 staff members Appropriate ratios and capacity were observed. LPA observed appropriate care and visual supervision during the inspection. According to Ms. Heater, on 1/16/26 at approximately 12:04 pm, staff S1, the lead teacher, began transitioning 7 children from Room 1 to the bathroom. Upon arriving at the bathroom, they only had 6 children, present – a fact that emerged when another teacher S2 found one child on the walkway leading to the bathroom. The child C1 had been left behind during the transition. Ms. Heater estimates the time the child was alone at about one minute, since S2 had just returned from lunch and clocked in at 12:05 pm. Another teacher, S3, took the child to the bathroom to join S1 and the other children. Ms. Heater states she was informed of the incident at 2:15 pm by S3, and shortly, thereafter, by S1. The child’s mother was informed at approximately 2 pm by S1. Following the incident staff S1 was placed on administrative leave. Ms. Heater stated that she has reviewed classroom transitions with the staff, as well as principles of active supervision. Pursuant to Title 22 of the CA Code of Regulations, the following Type B deficiency was cited (see LIC809-D). Exit interview conducted and report was reviewed with Leslie Heater, director. Notice of Site Visit was provided and must remain posted for 30 days. Appeal Rights provided. DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies: Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care. Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care. PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.
