Based on observation and interview, the licensee did not comply with the section cited above. Today, LPA observed an approximately 3-foot lattice style wooden fence and wooden post that was connected adjacently to the iron pool gate. This created a potential for children to climb over the iron gate. In addition, there was a patio furniture style side table next to the iron gate adding another climbing potential. Licensee confirmed the observation and indicated that she agreed it was a hazard. This poses a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee stated that she would remove the part of the wooden lattice fence enough to where it was no longer connected to the iron pool fence in order to avoid any risk of children being able to climb over the iron pool fence. Today, licensee moved the table away from the pool fence. Proof will be submitted to the Department by POC date 3/2/2023.
