Based on observation the licensee did not comply with the section cited above. Today, LPA observed a rusted pool latch (gate near the swing set, near back of the yard), preventing the self-latching mechanism to work properly. The gate had a lock on it today and this gate was only accessible through a separate gate that was latched today, making this area inaccessible. In addition, LPA observed two-fold up tables placed against the pool fence causing a potential climbing hazard for children to get to the pool. This poses a potential health, safety or personal rights risk to persons in care.

Resolution: Although the gate that had the rust and non-functioning self-latching mechanism was inaccessible due to a separate gate, LPA advised that all parts of the pool gate should be functioning and self-latching as stated in the regulation. Today, Licensee oiled the self-latching mechanism, and it became functional again upon LPA re-inspecting it. Licensee removed the fold up tables and stated she would not place any items against the pool fence that children could use to climb over. Licensee also completed a statement indicating she would inspect her gates and pool fence regularly to ensure everything was functioning and safe. LPA collected this statement. Deficiency cleared today.

Based on observation the licensee did not comply with the section cited above. Today, LPA observed multiple cleaning products under the accessible bathroom sink cabinet (ajax, bleach products) and a razor. Outside, LPA observed that the swing set was not anchored in two areas. The swing set also had a broken teeter-totter seat. In the back day care room, there was accessible disinfectant wipes and an approximately 3.5 ft by 3.5 ft cubby shelf that was not anchored (cubby furniture was unsteady and wobbly when inspected). This is a potential health, safety or personal rights risk to persons in care.

Resolution: Today, Licensee latched the bottom bathroom sink as the latch that was in placed was not secured upon initially inspecting it. Licensee anchored the cubby in the day care room. Licensee stated she would anchor the swing set and fix the teeter totter seat. Proof of Corrections will be submitted by the POC date of 9/14/2023.

Based on record review, the licensee did not comply with the section cited above. Assitant #2 did not have proof of Mandated Reporter Training. This poses a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee stated she will have assistant #2 complete required Mandated Reporter Training AB1207. A return inspection will be required.

CRITICALHEALTHCCR 102417(g)(4)(A)Type AAug 2, 2022

Based on observation the licensee did not comply with the section cited above. Outside there was accessible Raid insect killer without any child safety lock on the nozzle. Licensee placed it in an unlocked shed that also had a red gasoline container on the floor. In the accessible restroom, there was Bleach on the counter and cleaning supplies under the sink (Fabuloso, Lysol toilet bowl cleaner and Scrubbing Bubbles shower cleaner). This poses an immediate risk to the health, safety or personal rights risk to persons in care.

Resolution: Licensee locked the shed after reviewing the regulation indicating the requirement to lock poisons. Licensee removed the cleaning supplies from under her bathroom sink and placed them in a locked closet. Licensee also completed a written statement indicating that she understood that poisons should be locked and that hazardous items such as cleaning supplies should be made inaccessible to all children in care at all times.

Based on observation, the licensee did not comply with the section cited above. While inspecting the accessible yard, LPA observed a broken swing set and rust on another swing set. There was also a glass fish tank with debris as well as a dirty toy car and a loose cement block near the toy car. There was an accessible empty glass bottle. Inside was an infant (child #2) who was inside an infant rocking chair and an exersaucer jumper in the accessible office area. This poses a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee removed the exersaucer and rocking chair. LPA reviewed the regulations and provided licensee with a list of acceptible equipment she could use for care. Licensee stated she would throw away the debris in the back and remove the broken swing set. A return inspection will be required.

SERIOUSHEALTHCCR 102425(d)Type BAug 2, 2022

Based on interview, the licensee did not comply with the section cited above. During discussion about safe sleep regulations, licensee stated she places an infant (child #2) who is over 6 months old, on his/her side for sleeping along with a small sheer blanket. A blanket and pillow were observed inside the crib that infant #2 uses. The infant was not in care during the inspeciton. This poses a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee stated she would complete additional safe sleep training via the ccld.ca.gov website and also licensee will complete a statement to indicate her understanding of safe sleep regulations including the requirement of placing infants on their back and excluding any lose articles in the play yard or crib. A return inspection will be required.

CRITICALHEALTHCCR 102370(d)(1)Type AAug 2, 2022

Based on observation and interview, the licensee did not comply with the section cited above. Adult #1 was observed eating and sitting at the kitchen table upon LPA arrival. Adult #1 left immediately after LPA arrival. LPA inspected the whole house and found that a downstairs bedroom had a closet full of mens clothing, mens shoes, a projector screen that was on and a photo on the wall of adult #1. LIcensee denied that adult #1 lived in the home. Adult #1 and an Adult #2 had been previuosly denied a criminal record clearace and adult #1 and adult #2 had not proceeded with a criminal record exemption. This poses an immediate health, safety or personal rights risk to persons in care.

Resolution: Licensee stated she would not allow any uncleared adult (adult #1 and adult #2) to reside in the home as of today or be present while day care chidlren are in care. Licensee understands that additional civil penalties could be assessed for repeat violations if it is determined that adult #1 and or adult #2 are residing in the home or present in the home with day care children. A written statement was completed today and provided by the Department.
