Based on observation, the licensee did not comply with the section cited above. LPA observed one staff member supervising 29 children napping which poses a potential health, safety or personal rights risk to persons in care.

(a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement was not met when Director allowed staff to sound a loud alarm to frighten children in care as a form of punishment.

(b) The person who brings the child to, and removes the child from, the center shall sign the child in/out.
(B) Staff shall physically check on sleeping infant(s) every 15 minutes and document the following: (3) Infants up to 12 months of age who are sleeping in a position other than on their back. (a) If the infant’s Individual Infant Sleeping Plan [LIC 9227 (3/20)] does not have Section C completed, staff shall return the infant to their back for sleeping.
