Based on observation and interview, the licensee did not comply with the section cited above. Upon arrival, LPA observed adult #2 (who was confirmed not to have the required criminal record clearance) caring for children. Licensee was inside the home upon LPA arrival and stated adult #2 was helping momentarily while her regular qualified assistant was out this morning. This poses an immediate health, safety or personal rights risk to persons in care.
Resolution: Today, adult #2 left the facility immediately (with her own child and licensees child), leaving licensee with four day care children. LPA reviewed the requirement as stated above and indicated that her own child and the 4 additional children she had in care today did not require an assistant. Licensee stated she will submit written statement indicating her understanding that uncleared adults are not to provide care and supervision to the Department by POC date 9/16/2023.
