Responsibility for Providing Care and Supervision (a)(1) No child(ren) shall be left without the supervision of a teacher at any time.... Supervision shall include visual observation. This requirement is not met as evidence by: Based on LPA’s interviews, 6 out of 9 staff stated they witnessed child #1 (C1) left unattended on playground. This action poses an immediate risk to the health and safety to children in care.

.3 Teacher-Child Ratio (a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance. LPA reviewed Child Supervision Record (CSR) and confirmed that in preschool classroom at 8:37am, staff documented 14 children in care with 1 staff present. This action poses an immediate risk to the health and safety to the child in care.

This was not met as evidenced by: Based on interviews with staff and children, and documentation gathered from the facility LPA determined that staff #1 aggressively grabbed a child by the arm, moved them to another part of the classroom against their will, and yelled at this child. This child became distraught, cried, and vomitted as result of these actions. This is an immediate threat to this child's health, safety, and personal rights.

101212 Reporting Requirements (d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours.
