Based on the LPA's observations and a file review, the licensee did not comply with the section cited above in 102416.5(d)(1). The LPAs observed six infants (S1-S6) and two preschoolers present being supervised by two staff members. This facility is operating over ratio. This poses a potential health, safety or personal rights risk to persons in care.

Resolution: The licensee was provided a copy of the Title 22 regulations pertaining to capacity and regulations. The LPAs obtained a signed statement from the licensee regarding her understanding of the regulation cited above. Additionally, the licensee will create a written plan or schedule to ensure that the facility is operating within ratio and submit to the Department by 10/23/24.

Based on the licensee's own admission and a personnel file review, the licensee did not comply with the section cited above in1596.871(c)(1)(A). The licensee stated that her daughter (adult A1), a resident of this home, turned 18 years of age in March 2023 and has not received her criminal record and child abuse index clearances. The licensee stated that her daughter is not a staff member at the facility and is never left alone with daycare children. which poses a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee stated that her daughter will get livescanned and submit proof to the LPA by 10/09/23.
