Based on observation, the licensee did not did not comply with the section cited above due to the self-latching mechanism of the pool gate not being engaged at the time of inspection, leaving the pool accessible to children. This poses an immediate health, safety or personal rights risk to persons in care.

Resolution: Licensee corrected deficiency with LPA present by lubricating the self-latching mechanism so that it automatically catches and holds the gate latch when the gate swings backward. Licensee states that they will always double check the gate prior to the arrival of children to ensure that it is properly locked.

Based on record review, the licensee did not comply with the section cited above due to their Mandated Reporter training certificate having expired in 2/2022, which poses a potential health, safetly, or personal rights risk to persons in care.

Resolution: Licensee acknowledges that Mandated Reporter training must be renewed every two years and will provide a certificate of completion of Mandated Reporter training to LPA by the Plan of Correction due date.
