Based on observation and record review, the licensee did not comply with the section cited above in which assistant does not have a criminal background clearance which poses an immediate health, safety or personal rights risk to persons in care.
Resolution: Licensee and assistant will contact Guardian to proceed with the exemption process and will update CCLD and will re livescan assistant. Licensee will have enrolled families and new families completed the LIC 9224 and will be placed in each child's file.
