Based on record review, the licensee did not comply with the section cited above in that, 5 out of 5 staff did not have current influenza immunization or statement to decline and 1 out 5 staff did not have pertussis immunization, which poses a potential health, safety or personal rights risk to persons in care.

.5 Staff-Infant Ratio (b) There shall be a ratio of one teacher for every four infants in attendance. This requeriment was not met evidenced by: Based on LPAs interviews and record review, Director and Staff#4 confirmed that S4, who were not qualified, had provided care for the toddler alone on 02/22/2023, which put the facility out of ratio, this posed an immediate risk to the health, safety and personal rights of the children in care

Based on interview and record review, the licensee did not comply with the section cited above in that, the facility did not conduct a disaster drill within the last six months, which poses a potential health, safety or personal rights risk to persons in care.

Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations... to meet his/her needs. This requirement is not met eveidenced by: Based on interviews and record reviews, C2 and C3 had multiple incident reports, in which, both C2 and C3 exhibited aggressive behaviors towards others for approximately 1-2 years while attending facility, and facility did not have a plan to timely address and assist C2 and C3 in managing the challenging behaviors. This posed a potential risk to the health, safety and personal rights to the children in care.

.2 Infant Care Teacher Qualifications and Duties (b) Prior to employment, an infant care teacher shall have completed... three... units related to the care of infants... This requirement was not met evidenced by: Based on LPAs interviews and record review, Staff #4 did not meet qualification to work in the toddler classroom and had provided care for 2 toodlers in the the toddler classroom alone, for more than 30 minutes, this posed a potential risk to the health, safety and personal rights of the children in care.

Based on record review, the licensee did not comply with the section cited above in that, 3 out 5 staff did not have current mandated reporter trainings, which poses a potential health, safety or personal rights risk to persons in care.

Based on record review, the licensee did not comply with the section cited above in that that Staff 1 and 5 did not have health screening on file, Staff 5 did not have tuberculosis testing, which poses a potential health, safety or personal rights risk to persons in care.

Reporting Requirements (1) during the operation of the child care center of any of the events, a report shall be made to the Department... within the Department's next working day (D) Any suspected physical or psychological abuse of any child. This requirement was not met evidenced by: Based on interview, Director admitted that she did not report to the Department a suspected child abuse on 02/24/2022, which poses a potential risk for the safety of the children care.
