Based on LPA's observations and interview with Lead Teacher Veronica Reyes on 11/08/2022 at 2:00 PM, the faciltiy did not comply with the section cited above. LPA did not observe a working carbon monoxide detector in Room 1. This poses a potential health, safety or personal rights risk to persons in care.

(f) Solid waste shall be stored, located and disposed of in a manner that will not transmit communicable diseases or odors, create a nuisance, or provide a breeding place or food source for insects or rodents. (1) All containers used for storage of solid wastes, including moveable bins, shall have a tightfitting cover that is kept on; shall be in good repair; and shall be leakproof and rodent-proof.

(b) Testing results with fractional ppb readings of 0.5 ppb or greater...(1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. This requirement was not met as evidence by: Based on results submitted to the Department, the facility did not comply with the section cited above in Outlet "C" was reported to have an exceedance of 7.73 ppb, exceeding allowable limit for lead, which poses a potential Health, Safety or Personal Rights risk to persons in care.
