Limitations on Capacity The department shall develop guidelines and procedures to permit licensed child day care centers serving preschool age children to create a special program component for children between 18 months to three years of age... This requirement is not met as evidenced: LPA learned that facility allows children over three years old to remain in the toddler option classroom. This is an immediate risk to the health and safety of children in care.
Child #1, who is allergic to dairy, was served food containing dairy on July 1, 2022 which caused the child to have an allergic reaction. Staff were aware of the child's food allergies and needs; however, on this day they were short staffed and they inadvertently served the food to the child. This is an immediate health and safety risk to children in care.
101161 Limitations on Capacity (a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation.
101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.

This is an immediate risk to the health and safety of children in care.
To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature...This requirement is not met as evidenced: LPA learned that staff #1 handles children in a rough manner and at times speaks to them in mean freighting tone. LPA also learned that other staff who no longer work at the facility have also violated children's personal rights. This is an immediate risk to the health and safety of children in care.
