1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25On 12/15/2022 at 9:30 AM Licensing Program Analyst (LPA) Gigi Reyes conducted an unannounced Case Management inspection to follow-up on an Action Level Exceedance (ALE) reported to the Regional Office by the Division of Drinking Water (DDW), LPA met with Site Supervisor and explained the purpose of the inspection. Site Supervisor provided LPA a tour of the facility. There were 14 children in care at the time of the inspection. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every five (5) years after the date of the first test. If the water testing results indicate that the facility has an ALE, an immediate response shall be required pursuant to section 101700.3, which may include remediation. The Regional Office received an ALE for two (2 ) water outlets in this facility. The Center was notified by LPA Reyes of the results on November 14 via phone and email. LPA advised Program Coordinator that two fixtures, labeled A, and C exceeded the 5-ppb action level. The said fixtures are bubblers that have an ALE level of 8 and 31 respectively. Simultaneously Program Coordinator sent an email confirming the ALE at the CCC. During today’s inspection, LPA toured the entire facility and inspected the outlets in question. LPA observed that the affected fixtures are taped with label "Drinking Fountain Closed" As stated by Program Coordinator, prior to testing, the classroom offered water using a Britta filtered water pitcher, that CCC has not been using the bubblers for approximately 3 years. LPA provided a copy of PUB 515 and discussed the need for the Center to share this with families. LPA discussed a plan of correction with the director and informed director the Plan of Correction for lead exceedances must include notification of parents and information about what has been done (their current response, such as water fixture put out of use, and bottled water provided) and remediation plans for all water outlets. Site Supervisor stated that they have done the following actions Testing Report has been posted in the classroom which LPA likewise observed. Parents were notified electronically through Learning Genie application platform and in person. Prior to Lead Test, CCC uses bottled water, water pitcher refilled by purchased gallons of water. After the testing, CCC continues to offer bottled water, and refill children's personal bottled water with the purchased gallons of water.
