Based on record review, the licensee did not comply with the section cited above in 5 out of 5 reviewed children's files. The 5 reviewed files did not have copu of LIC 9224, which posed a potential health, safety or personal rights risk to persons in care.
Based on observation, interview, and record review, the facility did not comply with the section cited above. While touring the facility LPA Observed staff #1 caring for children inside the Preschool Classroom. Staff #1 stated she has been working at Tutor Time for approximately 2-3 months. Director stated Staff #1 started working at the facility on April 4, 2022 which poses an immediate health, safety or personal rights risk to persons in care.

Most facility children did not wear face coverings while in the facility as required by the CA Dept. of Public Health Guidance. This is a potential risk to the health and safety of children in care.

.7995 Immunizations Commencing September 1, 2016, a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. This requirement was not met as evidence by: Facility did not have proof of immunizations, MMR, TDAP during todays inspection for 4 staff. This poses a potential risk to the health of the children in care.
(a)(1) Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision... (1) No child(ren) shall be left without the supervision of a teacher... Supervision shall include visual observation. This requirement was not met: Based on interviews conducted, Staff were not visually supervising C1 or any of the children while they were in dance class with A1. This poses potential Health and Safety risk to children in care.

Teacher-Child Ratio 101216.3(a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c) below. This was not met as evidenced by: Based on information obtained from interviews with staff and parents, LPA has determined that around drop off times, about 2 to 4 days a week in the morning teachers are supervising more than 12 preschool children at one time for 5 to 15 minutes at one time. This presents an immediate health and safety risk to children in care.

In addition...(1) Events reported shall include the following: (B) Any injury to any child that requires medical treatment. This requirement was not met: Based on interviews conducted with S1. S1 was not aware and did not report the incident to the licensing department within 24 hours and submit the incident report withing 7 days. This poses a potential health and safety to the childcare children.
Based on interview and record reviews, the director failed to ensure her and staff have the current mandated reporter training certificate. This poses a potential Health and Safety risk to the children in care.
