Based on LPA observation, the Licensee does not have an ASTM F134623 pool cover OR ASTM 2208 pool safety alarm for the swimming pool and jacuzzi. Licensee also has a pool safety hook that is not within regulation.
Resolution: Licensee agreed to obtain either an an ASTM F134623 pool cover OR two ASTM 2208 pool safety alarms, one for each (the swimming pool and jacuzzi) by 03/24/2026. LPA will conduct a POC Case Management inspection.
Based on record review and interview with Licensee, Staff #2 did not have documentation of immunizations on file. This poses a potential risk to the health, safety, or personal rights of children in care.
Resolution: Licensee will provide immunization records for Staff #2 for TDap, MMR and influenza to Community Care Licensing and keep records on file at her facility by end of business day 03/21/2024.
During record review, LPA observed infant file did not contain a LIC9227 form. This poses a potential risk to the health, safety, or personal rights of children in care.
Resolution: Licensee states she will provide documentation of LIC9227 Form for infant to the CCL Fresno Child Care Office 03/21/2024.
Based on LPA's observation, the licensee used corporal punishment by spanking a child on the bottom with her hand for not listening to her. This poses an immediate risk to the health, safety, or personal rights of children in care.
Resolution: Licensee will write a letter to CCL about appropriate ways in working with challenging behaviors and watch the video on CCLD.ca.gov regarding personal rights by end of day on 03/21/2024.
Based on observation, the licensee did not ensure children in care were not subject to observing an inappropriate crime documentary discussing graphic topics and scenes which may frighten, traumatize and/or cause distress a child in care. This poses a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee will provide a letter to Community Care Licensing why crime documentaries are inappropriate and list alternative age-appropriate television shows by 03/21/2024.
During the inspection, LPA observed the Licensee to be supervising 11 children, one infant and 10 preschool age children in care without an assistant present, causing the facility to be out of capacity ,as licensee was the only adult in the home. This poses an immediate risk to the health, safety, or personal rights of children in care.
Resolution: Licensee contacted parents of child #1, Child #2, Child #3 and Child #4 and their respective parents picked up the children. Licensee's assistant arrived later in the day, bringing facility back into capacity. Licensee will provide CCL a written proptocol by end of day on 03/21/2024 on how she will handle situations when there is a potential for her to go over capacity/ ratio and notify parents that she is no longer accepting children for the day.
Based on observation, the licensee did not comply with the section cited above which posed a potential health, safety or personal rights risk to persons in care. There were 12 children at the time of inspection which included five infants.
Resolution: Licensee stated that she understands the ratio requirements and will discuss this with parents. Two infants were also picked up during the inspection.
