All children are under supervision, including visual supervision, of a teacher at all times. Facility meets teacher-child ratios. LPA reviewed a sample of children’s files and observed files were complete with contact information for authorized representative and or relatives or others who can assume responsibility for the child and medical assessment. LPA reviewed a sample of staff files and observed files were mostly complete with health screening, immunization records for influenza, pertussis and measles and current documentation of completed mandated reporter training; one staff was missing the mandated reporter training as well as her immunization records. LPA discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to resources such as forms, regulations Provider Information Notices (PINs), and Quarterly Updates. LPA discussed Reporting Requirements as outlined in the regulations (Section 101212). Ms. Puga was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. LPAs observed that a teachers aid was not on the staff roster of cleared adults, LPAs verified that staff was finger printed at the time of hire but failed to complete a LIC 508 so the finger prints were never associated to the facility. , based on LPA’s Record Review, at one time there were 8 children inside the bathroom (including C1) by themselves and unsupervised for about 2 minutes. At that time, Staff were in front of the Staff Break Room Door and Staff appeared to be in discussion. This poses a potential risk to the health, safety or personal rights to children in care.
, on the LPA Record Review that on 12/05/2024 in between 3:54 pm to 3:56 pm, C1 squeezed through the facility’s bottom fence out to the facility’s parking out. At 3:57pm, P1 saw C1 laying on the parking lot ground next to the facility’s fence, P1 got out from his car, carried and took C1 back to the facility’s front door. At this time, S1 came aware of the situation and run immediately to the front door, out to the parking lot, met P1 and C1, took C1 from P1 and brought C1 inside the facility which posed an immediate risk to the health, safety, or personal rights of children in care.
All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: (3) Request a transfer of a criminal record clearance as specified in Section 101170(f) or... At 10:30 am, during the LPA's Staff Record Review, Staff 1 initiated Background Check Process and was not associated to the facility which is a potential risks to the health, safety, or personal rights of children in care
(a)In addition to the sign-in procedure requirement of Section 101226.1(b), the licensee shall develop, maintain, and implement a written procedure to sign the child in/out of the child care center that shall, at a minimum, include the following:(1)The person who signs the child in/out shall use his/her full legal signature and shall record the time of day. At 10:15 am, LPA Estoesta observed 32 children in care and only 28 children in care were Signed In by their Authorized Representative through the Facility "Pro Care" software application which is a potential risks to the health, safety, or personal rights of children in care
