At time stamped of 06:08:24 PM, S1 reached the main door and followed C1 to the parking lot. P1 was parked right outside of the facility, got out of P1's car and went to take C1. P1 and C1 met with S1 at the facility's main door and discussed the incident. Based on LPA's Staff interview, Staff confirmed the mentioned incident happened on that date. Also, Staff also confirmed of the same nature of incident happened 2 times in the beginning of the year 2024. No report of any incidents submitted to the Regional Office. Based on LPA Estoesta's Staff Interview and Record Review, the Licensee failed to prevent C1 exiting the facility for approximately 10 seconds to the parking lot without a Staff supervision, and also the Licensee failed to follow Reporting Requirements regulation, therefore, the preponderance of evidence standard has been met, therefore the above allegations are to be SUBSTANTIATED. The Licensee were in violation of Section 101229 (a)(1) that no child(ren) shall be left without the supervision, including visual supervision, of a teacher at any time, except as specified in sections 101216.2 (e)(1) and 101230 (c)(1), and Section 101212(d) upon the occurrence, during the operation of the childcare center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. LPA Estoesta informed Helen Qiu that this report dated 05/10/2024 included a Type A and B Citations which shall be posted for 30 consecutive days as there is an immediate and potential risk to the health, safety, or personal rights of children in care. Also, LPA's informed Helen Qiu to provide a copy of this licensing report dated 5/10/2024 that documents of any Type A citation, to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
