Based on Assistant Director self-admission the facility failed to report structural changes and the use of an unlicensed outdoor space. This poses a potential health, safety, or personal rights risk to persons in care.
(a) Each licensee or applicant shall furnish to the Department reports as required by the Department..(d)Upon the occurrence, during the operation of the child care center..(1) a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours.(C)Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. Based recoreds review facility failed to report a unusal incident within 24hrs of occurring which posed an immediate risk to the health, safety, and personal rights of children in care.
(a) The licensee shall ensure that each child is accorded the following personal rights: (1) To be accorded dignity in his/her personal relationships with staff and other persons.
(b) The name of the child care center director, and any fully qualified teacher(s) designated to act in the child care center director's absence, shall be reported to the Department within 10 days of a change of child care center director or designee(s).

Based on interviews conducted child #1 ran out of the classroom and was refusing to return to the classroom. Staff #1 and Staff #1 held Child #1 hand, lifted him by the pants, and carried him to the classroom. which posed an immediate risk to the health, safety, and personal rights of children in care.
