(a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.

Based on observation and record review, the licensee did not comply with the section cited above that child #5 medication is expired. Which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on interviews, the licensee did not comply in the section above which Child #1 took their pants off in the playground and staff is unkown on how long was in the playground with no pants. This poses a potential health and safety risk to children in care.

(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training.

Based on observation, the licensee did not comply with the section cited above in that a storage room containing wood finish and cleaning supplies and kitchennet room containing carpenter ant and termites spray were observed to be unlocked and accesible to the children which poses an immediate health, safety or personal rights risk to persons in care.

Based on interviews, the licensee did not comply in the section above which Child #1 was unsupervised which caused child to wandered away from the premises. This poses an immediate health and safety risk to children in care.

Based on observation and record review, the licensee did not comply with the section cited above that child #5 medication is expired. Which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on observation, the licensee did not comply with the section cited above in that a storage room containing wood finish and cleaning supplies and kitchennet room containing carpenter ant and termites spray were observed to be unlocked and accesible to the children which poses an immediate health, safety or personal rights risk to persons in care.
