Reporting Requirements (d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d) (1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours...... This requirement was not met as evidence by two incidents that occurred on January 27 and January 29, 2025 that were not reported to the child’s authorized representative or to the Department as required. The failure to report incidents poses a potential risk to the childrens health and safety while in care.

file review of time sheets for staff and children. During the complaint investigation it was found that the facility has been out of ratio on more than one occasion. More specifically on 02/07/22, at 8:56 AM there were 29 kids present with one qualified teacher and two teacher assistants. Also, on 02/08/22 at 9:46 AM there were 36 children with one teacher and one aide. LPA also observed 23 children with one teacher and 2 aides on 04/04/22.

Personal Rights (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference.... This requirement was not met as evidence by video review, staff interviews, and observations, it was determined that a S#1 physically handled C#1 in a manner that violated the child’s personal rights. S#1 was observed grabbing C#1 forcefully by the arms and placing the child down on the floor in a forceful manner. S#1 also used a loud, yelling tone and placed foot over C#1's foot in a restrictive manner. Which poses an immediate risk to the child’s personal rights and physical safety.

It was found that the housekeeper and kitchen staff have been used on more than one occasion to help with the supervision and ratio of children. LPA also observed this on 04/04/22, the housekeeper was being used to assist with children both indoors and outdoors.
