Based on observation and record review, the licensee did not comply with the section cited above in 1 out of 4 children's medication were expired. LPA observed that Child #3 medication expired and was being stored at the facility, which poses/posed a potential health, safety or personal rights risk to persons in care.

-Personal Rights:(a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement is not met as evidence by: Based on interviews conducted with staff and day care children disclosures were made regarding a Personal Rights violation conducted by Staff #1. Staff #1, two (2) witnesses and more than one (1) child confirmed this information. This poses an immediate health and safety risk to children in care.

(6) When no longer needed by the child, or when the child withdraws from the center, all medications shall be returned to the child's authorized representative or disposed of after an attempt to reach the authorized representative.

(g) Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children shall be stored where inaccessible to children.
