Based on LPA’s interviews conducted disclosures confirmed by staff that incident took place where parent asked to come inside facility and Principal denied parent entry. Interviews with ten day care parents confirm that parents are denied entry and are not allowed to enter the facility due to COVID. This poses a potential health and safety risk to children in care.
Personal Rights states (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature... This requirement is not met as evidency by: Based on observations and interviews conducted the licensee did not comply with the section cited above in that 2 teachers have violated personal rights of child # 1 & # 2. This poses and immediate risk for children in care.
Based on observation, the licensee did not comply with the section cited above in that there was three Clorox Bleach spray bottles and one Borax detergent box found under the sink in Room 5 that were accessible to children. Which poses/posed a potential health, safety or personal rights risk to persons in care.
Based on interviews conducted by LPA Mireya Garcia on September 21, 2022 and October 12, 2022, it was determined that the personal rights of Child #1 were violated by Staff #1 and by Staff #4 on two separate occasions. This poses an immediate health and safety risk to children in care.
Based on record review, the licensee did not comply with the section cited above in that Staff # 5 does not have a current Mandated Reporter certificate on file which poses/posed a potential health, safety or personal rights risk to persons in care.

During LPAs interviews conducted with approximately (6) staff and (8) day care children, a staff witness, Child #7, and Child #9 confirmed information regarding Staff #1 violating a child’s personal rights on two separate occasions.This poses an immediate health and safety risk to children in care.
Based on observation, the licensee did not comply with the section cited above in that Room # 1 A and B was observed to be out of ratio with 25 children with 1 teacher and 2 aides and Room # 4 and 5 were combined and observed to be out of ratio with 25 children 1 teacher and 3 aides which poses an immediate health, safety or personal rights risk to persons in care.
