Based on observation, the licensee did not comply with the section cited above in that there was an unlocked cabinet in the staff lounge being used as a classroom with various cleaning and disifecting items.which poses/posed a potential health, safety or personal rights risk to persons in care.
staff disclosure and written declaration obtained. On 10/18/22, a staff grabbed/pulled a child by the arm causing the child to fall to the ground. This was an immediate risk to the health and safety of the child in care.
Based on LPAs interview disclosures on 08/10/2022 from child #1 who states staff #3 and staff #7 were outside when child fell. Staff providing care and supervision disclosed not observing or having any knowledge of child #1 being injured while in care. This poses an immediate health and safety risk to children in care.
staff disclosures and LPA observation. Information was obtained disclosing that children are unsupervised in the outdoor restroom area when a staff member is not physically inside of the restroom. LPA also observed this to occur during this inspection. Staff are not visually observing children when they are in front of the restroom door facing the playground or on the steps leading to the restroom. This is an immediate risk to the health and safety of children in care.
Personal Rights: The licensee shall ensure that each child is accorded the following personal rights: To be free from corporal or unusual punishment...: interference with functions of daily living including eating, sleeping or toileting... This requirement was not met as evidence by: Based on interviews S1 did not allow C1 to nap/rest and C1 was sent to the steam lab. This poses a potential health and safety risk to children in care.
Responsibility for Providing Care and Supervision: The licensee shall provide care and supervision as necessary to meet the children's needs. No child(ren) shall be left without the supervision of a teacher at any time... Supervision shal include visiual observation. This requirement was not met as evidence by: Based on interviewes S2 stated that S1 stepped out of the classroom leave S2 and S3 who are aides to provide care and supervision for a short period of time. This poses a potential health and safety risk to children in care.

Based on LPAs interviews conducted with Principal determined an incident occurred on July 19, 2022 where child #1 was injured while in care and child #1 received medical care days later. The facility failed to report the Unusual Incident to the Department within the required 24 hours of occurrence.

Based on LPA’s observation and interview on 08/10/22 disclosure confirmed by staff that incidents have occurred where teaching staff left the classroom leaving the aides in the classroom providing the care and supervision of children in care.
